We explicitly state that we shall not be held liable for any property damage, personal injury, fire-related incidents, loss of use, interruption of business, loss of profits, or any other consequential, indirect, incidental, punitive, or special damages arising from the use, malfunction, or defects in equipment.

BC Escooter Service Inc. assumes no liability for accidents, misuse, abuse, loss, or injury to the rider or any third party, even if attributed to factors such as ebike/electric scooter power, speed, improper or illegal parameter settings, or component defects or malfunctions. This limitation applies to all cases, whether arising from a breach of warranty, contract, tort (including negligence), strict liability, or any other legal basis.

By engaging with BC Escooter Service Inc., the customer expressly agrees that, under no circumstances, will BC Escooter Service Inc. be liable for any special, direct, indirect, incidental, or consequential damages, even if the company has been advised of the possibility of such damages. This disclaimer holds true regardless of the cause, be it a breach of warranty, contract, negligence, strict liability, or any other legal theory.

The customer takes all liabilities and responsibilities on all products including e-scooters, e-bikes, conversion kits, li-ion batteries, e-bike/e-scooter components, brakes, bike/scooter mechanical parts and adjustments, electrical wiring, unforeseen occurrences, safety issues, maintenance and services, etc.

The use of our products requires a certain level of physical strength and condition. Users should ensure that they have no physical, medical, or mental conditions that would impair their ability to operate or use the products. Users are solely responsible for the risks and damages related to product usage.

The use of our products may involve unforeseen risks that could result in physical injury to the user or damage to a third party or their property. Users should familiarize themselves with the proper use of the product, including all quick-release mechanisms, brakes, throttles, and gear shifters before use. Users are solely responsible for the risks and damages related to product usage.

BC Escooter Service is not responsible for any illegal use, non-authorized use, misuse, or abuse of products, and the loss, damage, expense, or injury resulting therefrom.

BC Escooter Service will not be responsible for any harm caused to the user or other individuals. All purchasers and users of BC Escooter Service's products are personally liable for any injury or damages incurred to themselves or others as a result of participating in the operation of our electric bikes and scooters.

We recommend that users subscribe to appropriate insurance coverage for the use of our products. Users are solely responsible for the fees and costs related to said insurance.

We strongly recommend that users wear an approved helmet (mandatory by law) and reflective or appropriate clothing, as well as other protective and safety gear and accessories during product use.

The use of our electric bikes and scooters may be subject to various rules and regulations at the municipal, provincial, and federal levels. It is the user's responsibility to familiarize themselves with applicable regional or territorial legislation and ensure compliance for the safe operation of our products. The maximum speed of the personal electrical vehicle must be 25 km/h or less on public roads.

It is the responsibility of the customer to carefully consider and accept these terms before acquiring any products or services from BC Escooter Service Inc.

Final Sale Items:

Tire, Tube, and Brake Pads: These items are considered final sale, and no refunds or exchanges will be provided under any circumstances.

Price Match Guarantee:

Our Price Match Guarantee ensures that you get the best value for your purchase with us. We will match the regular price of any identical item offered by a competitor. This guarantee applies only to items sold at their regular price and does not include items that are on sale or offered at a discount elsewhere. To request a price match, please provide proof of the competitor’s regular price for verification. We reserve the right to verify the competitor's pricing and the availability of the item before honoring the price match. Our goal is to offer you competitive pricing while ensuring the highest level of service and satisfaction.

Warranty:

Electrical Repair: BC Escooter Service Inc. provides a 15-day warranty for electrical repairs. This warranty covers the same repair service within the specified period.

Warranty details for all brand-new electric scooters and ebikes can be found on the respective product page. We encourage customers to review this information thoroughly to understand the specific coverage, terms, and conditions associated with each product's warranty.

This policy ensures transparency and empowers our customers with the necessary information to make informed decisions about their purchases.

Refunds and Exchanges for New Electric Scooters and E-bikes:

7-Day Return Window for New and Unused Items

Eligibility: E-scooters can be returned within 7 days of receiving them, provided they are in new, unopened, and unused condition. Accessories are final sale items and cannot be returned.

Refunds: Approved returns will receive a full refund minus shipping costs from our warehouse to the customer and a 2.9% card processing fee.

Non-Refundable Costs: Shipping fees are non-refundable. We advise using a trackable shipping service. The 2.9% card processing fee covers the non-refundable costs incurred through payment processing, which BC Escooter Service absorbs during purchase but must deduct from refunds due to its non-refundable nature.

Responsibility: Return shipping costs are the responsibility of the customer unless the return is due to our shipping error. Items that are damaged, scratched, or used will not be accepted.

Returns Outside the 7-Day Window

Conditions: Returns outside of the 7-day window may be accepted if the item is in new, unopened, and unused condition, subject to approval.

Restocking Fee: A 25% restocking fee of the purchase price, minus shipping costs and a 2.9% card processing fee, will be applied.

Shipping and Fees: Similar to returns within the 7-day window, return shipping is the customer’s responsibility, and damaged, scratched, or used items will not be accepted.

Opened or Used Items

Policy: We do not accept returns of opened or used items under any circumstances.

Order Cancellation

- Unshipped Orders: Can be canceled up to 3 business days before shipment, with a 2.9% merchant processing fee.

- Pre-orders: Deposits are refundable, subject to a 2.9% processing fee.

Defective Products

- Reporting: If you receive a defective product, please contact us immediately for repair or replacement arrangements, which will be at no cost to you.

- Continued Use: If the product continues to be used after noticing a defect, the return policy is not applicable.

Return Process

- Approval: You must obtain an approval letter before returning any product. The item must be in its original condition and packaging.

- Inspection: Returns are subject to inspection upon receipt. If an item is not in sellable condition, the return will be rejected, and the customer will bear the cost of return shipping.

- Refund: Approved returns will be refunded to the original payment method used.

Used Electric Scooters:

No refunds or exchanges will be accepted for used electric scooters. It is imperative that the scooter is returned in a brand-new condition without any signs of wear or usage.

These terms and conditions are governed by and construed in accordance with the laws of the province of British Columbia, Canada.
